Terms and Conditions

Applicable to all activities that Corsair Aviation, LLC is contracted to perform for any other party, including, but not limited to: clients, customers, passengers, brokers, and subcontractors.

All flights conducted by Corsair Aviation, LLC are operated under FAA Air Carrier Certificate 8ZMA365O. All subcontracted flights are operated by 14 CFR Part 135 air carriers.

 

Corsair Aviation requires full payment to advance book all charters.

 

Corsair Aviation reserves the right to reschedule or cancel any flight at any time for any reason without penalty.

Invoicing and Charges

The amounts reflected in any Quote are minimum estimated amounts based on computer generated flight times. If actual flight times exceed the quoted flight times, Corsair Aviation, LLC will invoice you based on actual flight times. Quoted price is valid for 48 hours from date quoted, and subject to aircraft and crew availability. All flights are subject to a 2-hour minimum unless stated otherwise. Delays due to weather, air traffic, or other factors are not contemplated in the Quote and will be invoiced as experienced. Miscellaneous expenses such as hangar fees, domestic handling (FBO parking/ramp/facility fees), and winter weather operational fees may not be included and will be invoiced at cost. Applicable Federal Excise Tax, Fuel Surcharge and Segment Fees are included in the Quote; however, these are subject to change and shall be invoiced accordingly. All invoices are due upon receipt. A valid credit card is required to be kept on file prior to booking any charter. Any invoice that remains unpaid for more than 30 days will be charged to the credit card on file and incur a 10% penalty. Any additional fees, taxes and handling charges not included in the Quote will be invoiced as and when incurred. 

 

Cancellation Policy

Cancellations require a minimum of 48 hours notice. A cancellation fee equal to 50% of your total cost will be charged on cancellations if the flight is canceled less than 48 hours in advance.  Cancellations less than 24 hours will be charged the full amount.

Special Events

Special events may incur additional costs such as overnight fees, FBO or handling fees, and crew transportation. Any additional costs not included in the original Quote will be reflected in your invoice.

Trip Interruption

Corsair Aviation, LLC does not guarantee aircraft or crew availability and reserves the right, in its sole discretion, to cancel, delay or alter the destination of any trip. In the event the scheduled aircraft is delayed, cancelled, or otherwise not available as a result of, but not limited to: mechanical difficulties, weather, acts of god, war, strike, riot, Acts of God, or other Force Majeure events, governmental intervention or action, or other causes beyond the reasonable control of Corsair Aviation, LLC, including, cancellation, diversion, and other actions taken by the aircraft owner or third parties, the Quote shall be considered cancelled. Corsair Aviation, LLC shall have no responsibility for any delay, cancellation, diversion, or unavailability.

 

Corsair Aviation, LLC is not responsible for expenses incurred by any passenger for replacement of transportation in the event of any delay, cancellation, diversion, or unavailability of the scheduled aircraft. Partial completion of any trip shall be invoiced accordingly.

Itinerary Change and Transmittal of Changes

Schedule changes are permitted up to 24 hours advance of scheduled departure time and are subject to aircraft and crew availability, and Quote modification. Notification of changes or cancellations must be made directly to Corsair Aviation, LLC. Changes made after acceptance and execution of the original Quote will be accommodated at the discretion of Corsair Aviation, LLC. If changes are required during flight, requests shall be made with the Captain and applicable charges will apply.

Late Passenger Arrival

Passengers must arrive no later than 10 minutes prior to the specified time of departure. Failure to arrive within this time limit will subject the trip to cancellation at the sole discretion of Corsair Aviation, LLC and 100% forfeiture of trip payment. Any additional expenses or fees incurred by Corsair Aviation, LLC as a result of late passenger arrival shall be invoiced as experienced. At the discretion of Corsair Aviation, LLC additional standby time or delayed departure may be arranged at the request of the customer and will incur additional fees.

Crew Duty and Flight Time Limits

In accordance with FAA regulation and company policy: flight time is limited to 8 hours based on a 14-hour duty day. A required rest period of 10 hours is required within a 24-hour period. Should these limits be compromised for any reason, the flight shall be delayed as necessary and additional charges will apply.

Catering and Alcohol

Special catering and alcohol is available upon request at least 48 hours prior to the scheduled departure time and will be invoiced accordingly. FAA regulations prohibit passengers from carrying any alcohol onboard the aircraft for consumption during flight. Passengers who appear intoxicated will be denied boarding and access to the aircraft. In such cases the flight shall be cancelled and customer shall forfeit all payments.

Aircraft Performance

The performance of the aircraft may be limited by passenger payload, airport elevation, and/or actual weather conditions day of flight. In some cases, fuel stops may be required based on these factors and additional fees may be incurred by the customer. Passengers must provided actual weights prior to boarding.

Baggage

Corsair Aviation, LLC is not responsible for shipping excess (or rejected) baggage. Due to aircraft limitations, any excess baggage that cannot be taken aboard the aircraft will be rejected by the operator. Flights cancelled as a result of rejected baggage are non-refundable.

​

Restricted Articles

Federal law forbids the carriage of hazardous materials aboard aircraft in your baggage or on your person. A violation can result in 5 years imprisonment and penalties of $250,000 or more. (See 49 CFR 5124) Hazardous materials includes explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples include: paints, lighter fluid, fireworks, tear gases, oxygen bottles and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on on your person.

 

Federal law provides that no person shall carry a deadly or dangerous weapon, either concealed or unconcealed, aboard any aircraft except: (1) employees or officials of a municipality or State, or the United States, who are authorized to carry firearms (e.g. FBI, Secret Service, LEO prisoner escort, Federal Air Marshall), or (2) crew members and other persons authorized by the operator to carry firearms. Appropriate documentation and identification will be required of any passenger traveling under this provision. Firearms that are unloaded, dismantled and encased in a hard-sided suitable locked container may be carried as checked baggage, subject to operator-specific procedures. Ammunition must be securely packaged in a container made of durable fiber, wood or metal, or in the manufacturer's original package to a maximum not exceeding 11 pounds. The passenger will be required to complete applicable declaration forms.

FBO / Executive Terminals

Corsair Aviation, LLC reserves the right to assign a Fixed Base Operator (FBO) at each airport of landing. Special requests will be accommodated on a case-by-case basis and additional fees may apply.

Aircraft Damage and Cleaning Fees

In the event that the aircraft is damaged or soiled by you or your guests beyond normal wear and tear conditions, you will be charged for cleaning and/or repair costs including loss of use of the aircraft and incur a minimum fee or $1500. Smoking is NOT permitted at any time onboard or near any aircraft.

Operational Control 

FAA regulations require Corsair Aviation, LLC to maintain operational control at all times under 14 CFR Part 135. At no time will any passenger, client, customer, or any other entity have operational control over the aircraft or pilot(s). 

​

Security Policy

Due to Federally mandated security measures, all passengers 18 years of age or older must present a valid government issued photo I.D. prior to boarding (no exceptions). All passengers 17 years of age and under must provide documentation of parental authorization to travel in a form acceptable to Corsair Aviation, LLC. A lead passenger must be named for all legs of the charter flight along with contact information. Unlisted passengers and/or failure to provide proper documentation may cause significant delay or cancellation of the flight. Passengers are solely responsible for obtaining any travel authorization documents required. Additional fees may apply for delays caused by failure to provide proper documentation.

 

Consent and Agreement

Confirmation of booking shall constitute an informed and knowing consent and waiver as required by law. You also acknowledge the permissions and consents set forth in the Corsair Aviation Cancelation Policy and Release of Liability. The cardholder/authorized signatory authorizes Corsair Aviation to charge his/her credit card at the time of booking. Cardholder also understands and authorizes the credit card to be charged if Cardholder fails to cancel this booking without 48 hours notice per the cancellation policy.

Release of Liability

You acknowledge and assume the risks involved in participating in flight activity with Corsair Aviation, LLC. The term "flight activity" shall refer to all activities, events or services provided, arranged or organized by Corsair Aviation, LLC including, but not limited to: flight orientation and instruction sessions, air tours & charters, surface transportation, including all helicopter and airplane flights; loading, unloading and flights in or movement around aircraft.

 

You acknowledge and agree to indemnify and hold harmless Corsair Aviation, LLC and its officers, partners, agents, employees, parent corporations and subsidiaries from and against all claims, allegations, demands, liabilities, fines, losses, damages, costs and expenses (including, without limitation, reasonable fees and expenses of attorneys and any amounts paid in settlement) arising out of or related to: (i) your participation in flight activities (ii) the breach by Corsair Aviation, LLC of any of its material obligations under any Agreement, or (iii) the negligence, gross negligence, bad faith, intentional or willful misconduct of Corsair Aviation, LLC, it employees or other representatives or affiliates. You agree and assume full responsibility and risk in participating in the flight activities.

 

Assumption of Risk and Release of Liability

Governing Law

The terms of the Quote shall be governed by and construed in accordance with the laws of the State of California without giving effect to any laws pertaining to conflicts of law. Any action hereunder shall be subject to the exclusive jurisdiction of state and federal courts sitting in California.

​

Severability

Any term or provision of the Quote that is invalid or unenforceable in any situation in any jurisdiction shall not affect the the validity or enforceability of the remaining terms and provisions hereof or the validity or enforceability of the offending term or provision in any other situation or any other jurisdiction.

​

Waiver

A waiver, whether oral or in writing, expressed or implied, by any Party or any failure by a Party in the observance and performance of any of the terms, conditions, obligations, responsibilities, or duties set forth in the Quote shall not constitute or be construed as a waiver of any subsequent or other failure. 

 

Assignment

Neither Party may sell, transfer or assign the Quote or any rights hereunder without the written consent of the other; provided, that Corsair Aviation, LLC has the right to provide you with an equivalent or better aircraft operated by Corsair Aviation, LLC, or by another operator qualified under applicable FAA regulations.

 

Enforceability

The rights and obligations of the Parties hereunder shall inure to the benefit of, and be binding and enforceable upon, the respective successors, permitted assignees, and permitted transferees of any Party. No permitted assignment or transfer shall relieve the assigning or transferring Party of responsibility for the obligations so assigned or transferred.

Amendment

No amendment of any provision of the Quote shall be valid unless the same shall be in writing and signed by the Parties.

​

Headings

The headings contained in the Quote are inserted for convenience only and shall not affect in any way the meaning or interpretation of the Quote.

​

Entire Agreement and Authorization

This Quote has been duly executed by an authorized representative of each Party, and contains the entire understanding of the Parties as to its subject matter, supersedes all prior oral agreements and writings, and can only be modified in writing signed by both Parties.
